PENANG, July 16 (Bernama) -- The Asian International Arbitration Centre (the “AIAC”) is embarking on its third series of Roadshows its Standard Form of Building Contracts (the “SFCs”) to familiarize key industry players with the AIAC SFCs, which include the AIAC 2019 SFC Main and Sub-Contract (the “AIAC 2019 SFCs”), Design and Build Contract, as well as Minor Works Contract.
The AIAC began the first venue of the 2019 SFC Roadshows on the 3
rd July 2019 in Kuala Lumpur. On 16
th July 2019, the AIAC conducted the SFC Roadshows in Penang at Hotel Jen and is going to announce the next date and venue for their SFC Roadshows date in Sabah, Sarawak and Johor in the later part of 2019. The AIAC strives to cover as many regions as possible in order to share and spread knowledge on the best practices within the construction industry.
This year, the SFCs Roadshows focus not only on the key features of the SFCs, but also how Arbitration, Adjudication, and Mediation play a role in the AIAC SFCs. Participants will hear from the AIAC SFC Expert Advisory Committee, which comprises of construction industry experts, about how the SFCs cater to the construction industry’s best practices and the amendments made to best suit its users. Additionally, the experts will explain the relationship between the SFCs and alternative dispute resolution mechanisms in fostering an environment of dispute avoidance.
The topics that were covered
during the roadshow by AIAC’s Expert Advisory Committee are:
· Introduction to the AIAC 2019 SFCs (Main and Sub Contract)
· AIAC Design and Build Contracts and Minor Works Contract
· ADR as Contained in the AIAC SFCs and CIPAA Overview
· Bird’s Eye View: CIPAA from Various Stakeholders’ Viewpoints
The Roadshow pointed out the key features of the AIAC 2019 SFCs. One of them is the introduction of the role of the Contract Administrator to enable the Architects, Quantity Surveyors, Engineers, and other construction stakeholders to come on board the building project and broaden the scope of their roles. Additionally, the AIAC 2019 SFCs are a unified single contract, without the distinction between with or without quantities, which allows for more efficiency and for the parties to customise the contract to their specific needs.
Finally, the AIAC 2019 SFCs addressed one of the most important requirements of any standard form of building contracts – customisability. Users of the AIAC 2019 SFCs are granted with the liberty to modify, revise, and download the SFCs in their newly revamped AIAC SFC website portal (
http://sfc.aiac.world) free of charge. This is a testament of the AIAC’s mission to make the 2019 SFCs more accessible and embraced to their users not only in Malaysia, but across the region.
The Kuala Lumpur and Penang roadshows were attended by more than 300 construction professionals, lawyers, quantity surveyors, academicians and other interested stakeholders.
